Refund Policy.

This Cancellation and Refund Policy is incorporated into the Terms and Conditions governing all bookings with Soirée Cabaret Productions (“Soirée”, “we”, “our”, or “us”). By securing a booking with us, you agree to the terms below.
This policy aligns with your rights under the Australian Consumer Law (ACL) and the Fair Trading Act 1987 (NSW). Nothing in this policy limits, modifies, or excludes any legal rights that cannot be excluded under law.
1. General Policy: Entertainment and Event Services
All confirmed bookings for entertainment and event services are strictly non-refundable. This includes, but is not limited to:

Live entertainment (drag, burlesque, circus, cabaret, musicians, etc.)

Photography and videography
-
Catering and bar service coordination
-
Audio visual (AV), lighting, staging, and effects
-
Wedding or event planning and coordination
We allocate performers, staff, subcontractors, and equipment based on your confirmed date, which prevents us from reselling the service in the event of cancellation.
2. Performer Cancellations or Unavailability
If a booked entertainer becomes unavailable due to illness, emergency, or unforeseen circumstances, Soirée will:

Source a suitable replacement at no additional cost

Ensure the replacement meets the intended tone, quality, and style

Communicate promptly and transparently with the client
If a replacement cannot be sourced:

A credit note will be issued for the affected entertainment component, valid for 12 months
-
Refunds will not be issued unless required under the ACL

3. Third-Party Services (Photography, Videography, Catering, AV, Wedding Planning)
Soirée works with trusted subcontractors and third-party service providers. The following terms apply:

a) Photography & Videography

Changes to booked media services within 30 days of the event are non-refundable and may not be transferable.

In the event of equipment failure, file corruption, or provider unavailability, Soirée will offer:

Rescheduling where feasible
-
Partial credit for undelivered services
-
Replacement provider if time permits
-
-
Final edited deliverables are subject to turnaround times agreed upon in writing and may not be rushed.

b) Catering Services
-
Soirée coordinates with external caterers where required.
-
Final guest numbers and menu selection must be confirmed 21 days prior to the event.
-
Reductions in guest numbers after this date will not result in a price reduction or refund.

Dietary requirements must be communicated in writing; Soirée is not liable for uncommunicated allergens or intolerances.
c) Audio Visual, Lighting & Staging
-
Technical production requirements must be finalised 14 days before the event.
-
Last-minute changes are subject to availability and may incur additional costs.

Any client-supplied equipment must be tested and approved by our technicians in advance.

d) Wedding and Event Planning Services
-
Planning packages are booked in stages (consultation, design, vendor management, day-of coordination, etc.).
-
Once a stage of service is delivered, it is non-refundable regardless of whether the overall event proceeds.

Cancellation of the event after services are rendered (e.g. run sheet creation, vendor negotiation) will not result in partial refunds.

4. Changes or Cancellations by the Client

All bookings are non-refundable regardless of notice.
-
Rescheduling is subject to availability and must be requested at least 21 days in advance, with a $250 administration fee plus third-party rescheduling fees.
-
Rescheduling may not be possible for weddings or complex productions and may require a full rebooking at prevailing rates.

5. Force Majeure
If an event cannot proceed due to an act of God, government restriction, pandemic-related shutdown, extreme weather, or venue-related disruption, we will:

Attempt to reschedule all services
-
Issue a credit note if rescheduling is not possible
-
Apply reasonable discretion where costs have already been incurred
Refunds are not guaranteed and will only be considered where legally required under the ACL.

6. Client Responsibilities & Code of Conduct
-
Clients are responsible for maintaining a safe, respectful, and harassment-free environment for performers and contractors.

Any abuse, intoxicated misconduct, or venue conditions that compromise safety will result in immediate termination of services without refund.

7. Refund Requests & Credit Notes
All requests must be submitted in writing to soiree@axisglobal.co. Soirée reserves the right to:

Refuse refund requests not aligned with this policy

Offer credit notes for future use, at its sole discretion

Validate claims with medical documentation, police reports, or vendor correspondence where applicable

8. Payment Terms
-
Bookings are only confirmed once the agreed deposit or full payment is received.
-
Missed or late payments may result in cancellation without refund.
-
All staged payments must be made according to the agreed schedule. Failure to do so may trigger cancellation and forfeiture of previous instalments.

9. Refund Processing
Where a refund is required by law:

Refunds will be processed within 14 business days

Refunds will be returned to the original payment method
-
Refunds will not exceed the amount paid
